Who we are

KAHUNA is operated by D Lavery trading as Kahuna Premium Sportswear, 5a North End, Ballyclare, Co. Antrim, BT39 9BN, Northern Ireland, United Kingdom.

Email: sales@kahuna.ie

We are the data controller for personal information used to operate our business, fulfil orders and manage customer relationships. Our online store is hosted by Shopify. Shopify processes information on our behalf and, for certain services, for its own purposes as explained below.

This policy explains how personal information is collected, used and shared when you browse our store, buy products, contact us or otherwise interact with our services. Reading or using our website does not, by itself, constitute consent to marketing or optional tracking.

Personal information we collect

Depending on how you interact with us, information may include:

Contact information: your name, email address, telephone number, billing address and delivery address.

Order and transaction information: products ordered, sizes and other variants, prices, payment status, delivery information, purchase history, refunds, returns, Returns Authorisation Numbers (RANs), warranty enquiries and complaints.

Payment information: information needed by payment providers to authorise and process transactions. Payment providers may process card or account details. The information available to KAHUNA depends on the payment service and may include transaction references, payment status and limited payment-method details. Please do not send full card details to us by email or through contact forms.

Account information: account identifiers, contact details and preferences where you create or use a customer account.

Communications: enquiries, correspondence and information or photographs you choose to provide when seeking support.

Device and usage information: IP address, browser and device details, identifiers, pages visited and interactions with the store. The collection of optional tracking information depends on the features enabled and your choices where consent is required.

Optional features: if you use features such as reviews, wishlists, promotions or marketing sign-ups, we process the information you provide and the relevant interactions needed to operate those features.

Where information comes from

We obtain information directly from you when you browse, order, contact us or use available features; automatically through the store and permitted cookies or similar technologies; and from providers involved in processing payments, preventing fraud, delivering orders and operating the store.

We may receive delivery updates from carriers, payment and dispute information from payment providers, and information from someone placing an order for delivery to another person.

Why we use information and our lawful bases

Orders and customer requests

We use relevant contact, transaction and delivery information to take steps at your request before a purchase and to perform our contract with you. This includes taking payment, supplying goods and sending order and delivery communications.

Returns, refunds, warranty claims and complaints

We use relevant information to perform our contractual obligations and comply with consumer law. We also have legitimate interests in keeping appropriate records, investigating issues and establishing or defending legal claims.

Accounts

Where accounts are offered, we use information to provide the account service you request. We have legitimate interests in maintaining secure accounts and administering customer relationships.

Enquiries

We use information to respond to questions and provide support. Our basis is taking steps at your request before a contract, performing an existing contract, or our legitimate interests in answering general enquiries, depending on the circumstances.

Security and fraud prevention

We have legitimate interests in protecting customers, payments, our systems and our business, investigating misuse and preventing fraud. Some processing may also be needed to comply with legal obligations.

Legal and accounting records

We process information where necessary to comply with applicable accounting, tax, consumer protection and other legal obligations.

Marketing

We use consent where required for marketing emails, text messages, personalised advertising and associated tracking.

Where the law permits marketing to existing customers without separate consent, we may rely on legitimate interests, provided the relevant legal conditions and opt-out requirements are met.

You can object to direct marketing at any time.

Service improvement

We have legitimate interests in understanding and improving the store and resolving technical problems. Where cookies or similar technologies require consent, we obtain that consent rather than treating legitimate interests as a substitute.

Optional features

We use information to provide the feature you request and, where appropriate, rely on legitimate interests in administering it. Separate information will be provided where a feature involves additional uses.

Where we rely on legitimate interests, we consider the necessity of the processing and its impact on your rights and interests.

If you do not provide information needed to process an order, arrange delivery or meet a legal obligation, we may be unable to complete the purchase or provide the relevant service. Optional marketing choices are not a condition of purchasing.

Who receives personal information

We share relevant information with providers involved in operating our business, including Shopify, payment processors, delivery carriers, IT and hosting providers, customer-support services and providers of business administration, accounting and order-management systems where used.

Providers acting on our behalf receive information needed for their work and are subject to appropriate contractual obligations. Some providers, including certain payment services, also act as independent controllers for their own legal, security or service purposes.

Where optional marketing, advertising, analytics or other integrations are enabled, relevant information may be shared with their providers, subject to applicable law and consent requirements.

We may disclose information to professional advisers, regulators, courts or public authorities where necessary and lawful, and where needed to establish, exercise or defend legal claims.

If the business is sold or reorganised, relevant information may be disclosed to advisers and a prospective or actual successor, subject to appropriate safeguards and applicable law.

We do not assume that every provider receives all the information we hold.

Our relationship with Shopify

Shopify hosts our store and processes information to provide services such as checkout, store operation, security and related functionality.

Where Shopify Network Intelligence and Enhanced Services are enabled, Shopify may also use information about interactions with our store, other merchants and Shopify to personalise experiences, provide relevant advertising, improve services and understand customer interactions. This can involve sharing activity information with Shopify and other providers in other countries.

For some of these purposes Shopify acts as an independent data controller. Shopify explains its own purposes, lawful bases and responsibilities in its Consumer Privacy Policy. These may include consent for personalised advertising and legitimate interests for specified service-improvement, reporting and related purposes.

Your store consent and opt-out choices apply as required by law and through the relevant Shopify tools and integrations. Contact us if you need help understanding which services are involved.

Cookies and similar technologies

Our store uses cookies and similar technologies for functions such as operating the basket and checkout, security and remembering relevant choices.

Optional analytics, advertising and personalisation technologies depend on the services enabled. Where the law requires consent, these technologies must only be used after that consent has been obtained.

You can use the cookie controls made available on the store to manage your choices, or contact us for assistance. You can also manage cookies through your browser, although blocking necessary cookies may affect store functionality.

Our Cookies Policy provides further information. Accepting this Privacy Policy is not a substitute for consent to optional cookies.

Marketing choices

You can unsubscribe from marketing emails using the unsubscribe link in the message or by contacting sales@kahuna.ie. For other marketing channels, use the opt-out instructions supplied or contact us.

Withdrawing consent does not affect processing that was lawful before withdrawal. We may retain limited suppression information to respect your choice and avoid sending further marketing.

Order confirmations, delivery updates, refund information and responses to your enquiries are service communications and may still be sent when you opt out of marketing.

How long we keep information

We retain personal information only for as long as necessary for the purposes described in this policy.

For order, payment, return and accounting records, we consider applicable statutory record-keeping requirements, warranty and consumer obligations, and the periods during which relevant legal claims may arise.

For account information, we consider whether the account remains active, the service requested and any records we must retain independently of the account.

For enquiries and complaints, we consider when the matter was resolved and whether information is still needed for follow-up, evidence or legal obligations.

For marketing records, we consider your consent or other applicable marketing basis, your engagement and any objection or withdrawal. Limited suppression records may remain necessary to honour an opt-out.

For technical and security records, we consider the investigation, troubleshooting and security purpose, the sensitivity of the information and the risks involved.

When information is no longer required, we delete or anonymise it, subject to appropriate backup and deletion arrangements. Contact us for more information about retention for a particular record.

International transfers

Shopify and other providers may store or process information outside the UK or the country where you live.

Where a restricted international transfer takes place, we use an applicable lawful transfer mechanism. Depending on the destination and provider, this may include an adequacy decision, approved contractual safeguards such as the UK International Data Transfer Agreement or UK Addendum, or EU Standard Contractual Clauses where relevant.

You can contact us for information about safeguards relevant to your information and how to obtain a copy, subject to appropriate protection of confidential information.

Security

We use appropriate technical and organisational measures to protect personal information. No internet service can guarantee absolute security.

Keep account access details confidential and contact us if you suspect unauthorised access. Do not send unnecessary sensitive information, full payment card details or passwords through ordinary email or contact forms.

Your data protection rights

Depending on applicable law and the circumstances, you may have rights to access your personal information, correct inaccuracies, request deletion, restrict processing and receive or transfer certain information in a portable format.

You may object to processing based on legitimate interests on grounds relating to your particular situation.

You have a separate right to object to direct marketing, including related profiling, at any time. We will stop using your information for those direct-marketing purposes.

Where processing relies on consent, you can withdraw it at any time.

If a decision made solely by automated processing produces legal or similarly significant effects, applicable law may give you rights to information, human intervention and to challenge the decision.

Contact sales@kahuna.ie to exercise your rights. We may need proportionate information to verify your identity. An authorised representative may act for you where appropriate.

Requests are normally free of charge. We respond within the applicable legal timeframe, usually one month, subject to lawful extensions or exceptions which we will explain where relevant.

Some information may need to be retained to comply with legal obligations or establish, exercise or defend legal claims. We will explain relevant restrictions when responding.

Children's information

Where children interact with the store or information about a child is supplied, that information remains protected by applicable data protection law.

Parents or guardians who believe a child has supplied personal information and have concerns should contact us. We will consider the child's rights, age and circumstances when responding.

Third-party websites

Our store may link to external websites or offer third-party services. Their own privacy information explains how they use information for their purposes. Review it before providing information directly to them.

Privacy complaints

Contact sales@kahuna.ie or write to our business address if you have concerns about how we use your information. We will investigate and respond.

You also have the right to complain to the Information Commissioner's Office (ICO), the UK data protection regulator:

https://ico.org.uk/make-a-complaint/

You do not have to complete mediation or another private dispute-resolution process before contacting the ICO.

If applicable, you may also complain to the relevant supervisory authority in the European Economic Area, including where you live, work or believe an infringement occurred:

Changes to this policy

We may update this policy when our practices, services or legal obligations change. The latest version will show a revised date. We will provide additional notice where required.
